Competition over the use and management of water resources
continues to be of critical importance in Montana. New and
proposed legislation, ongoing litigation, and a developing water
market will have a significant role in shaping the future of
Montana and the region.
This program addresses recent developments expected to affect the
public, business, all levels of government, and the environment,
both in the state and regionally. Topics to be covered include water
rights valuation, land use planning and water permitting, and
tribal water rights. Other topics to be discussed are municipal
water rights, the Clean Water Act, and interstate disputes.
We have assembled representatives from federal, state and local
governments, consultants, and practitioners to provide useful
suggestions and insights on these and other water resource issues
affecting Montana.

Holly J. Franz, Program Co-Chair, is a partner with Franz &
Driscoll PLLP. Her practice concentrates on water, natural
resources, and environmental law, where she is well recognized
for her extensive water rights legal practice.
John E. Bloomquist, a partner at Doney Crowley Bloomquist Payne Uda PC, has been involved in all aspects of the livestock industry. His practice focuses on water, public lands, natural resources, real estate, and governmental relations law.
Sarah A. Bond is an Assistant Attorney General with the Department of Justice, Montana Attorney General’s Office. She
specializes in water law, Indian law, and is counsel of record in the
original jurisdiction action Montana v. Wyoming, Original 137.
Stephen R. Brown is a partner with Garlington Lohn Robinson PLLP where he concentrates his practice in the areas of environment,
natural resources and land use law. He also assists clients
with water rights, timber, water and air quality, and hazardous waste.
Karen Budd-Falen is co-owner of the Budd-Falen Law Offices LLC, located in Cheyenne, Wyoming. She currently serves as
legal counsel to the Arizona/New Mexico Coalition of Counties
for Stable Economic Growth.
John B. Carter has represented the Confederated Salish and Kootenai Tribes of the Flathead Nation in natural resource,
jurisdiction and water rights matters for over 20 years.
Susan Cottingham is a Staff Director for the Montana Reserved Water Rights Compact Commission where she directs
the negotiation of Indian water rights settlements as well as
settlements with federal agencies.
Frank C. Crowley is a shareholder with Doney Crowley Bloomquist Payne Uda PC. His current practice is primarily
focused on estate planning, however, he also practices environmental
law, real estate, probate, zoning and land use law.
Tim Davis, Director of the Montana Smart Growth Coalition, works on growth policies, land use and planning legislation,
and cutting edge land use regulations in Montana.
Senator Jim Elliott is Chairman of the Water Policy Interim Committee and has been a Montana State Senator for District 7 since 2000. He also served eight years in the Montana House
of Representatives as well as running his ranch.
Brian K. Gallik is a partner with the Bozeman firm of Goetz Gallik & Baldwin PC. He is engaged in the general practice of
law including civil and criminal litigation in state and federal
courts. He also represents clients in the area of land use planning.
Andy Hunthausen is a County Commissioner in Lewis and Clark County which is facing significant growth pains. Lewis and Clark County has been hit head on with issues around water quality
and quantity, zoning, impact fees, and infrastructure deficiencies.
Senator Larry Jent is a principle in the firm of Williams & Jent PLLP, a Montana State Senator for District 32 and the
2007 Conservation Legislator for the MT Wildlife Federation.
Alan L. Joscelyn is a partner with Gough Shanahan Johnson & Waterman. He assists property owners, natural resource users
and developers to respond to the legal issues and conflicts arising
from environmental regulation of natural resource development.
Joe Kolman has been an environmental policy analyst for the Montana Legislature over the last five years, working on the
issues of water, oil and gas development, land use and wildlife.
Glenn Oppel has been serving as the Montana Association of REALTORS® Government Affairs Director since 2004. He
previously worked as Government Affairs Director with the
Billings Association of REALTORS®.
Damon Pellicori Water Resource Manager with the Montana Water Trust, conducts water rights research, evaluates instream
flow projects, and manages water leases and transfers through
the State’s regulatory process.
Myra Shults has been an attorney for 26 years and currently
practices land use law representing counties. She attends the
meetings of the Water Policy Interim Committee and recognizes
the need to coordinate land use law with water law.
Allan E. Steinle, U.S. Army Corps of Engineers, has served
with the Corps since 1982 and is currently the State Program
Manager for the Regulatory Program in Montana.
Deborah Stephenson, a Senior Associate at WestWater Research LLC, has experience working with municipalities and communities throughout
the Western U.S. on water supply planning and development.
Susan B. Swimley an attorney in Bozeman, Montana, has practiced emphasizing
land use (subdivisions, zoning and road issues) and real estate since 2000.
Matthew W. Williams is a partner with Williams & Jent PLLP
where he focuses on water rights and environmental issues. He
has been involved in water law for over 20 years.
Anne W. Yates is Deputy Chief Counsel for Water for the Department of Natural Resources and Conservation. Prior to
this, she was in private practice in Washington, D.C.
