Overview

The construction market is in crisis. Credit is tight or nonexistent. The normal money flow from owner to contractor to subcontractor is constricted. Conditions are ripe for more disputes, but with less money or appetite for traditional mediation, arbitration and litigation. The construction industry is demanding quicker, more cost-effective means of resolving disputes.

Jennifer W. Fletcher, Program Co-Chair, a partner with Sutherland Asbill & Brennan LLP, serves as Team Leader of the firm’s Construction Industry Practice Group and is a member of its Executive Committee and its Litigation Group. Her practice involves construction industry issues exclusively.

John W. Hinchey, Program Chair, is a partner at King & Spalding LLP and serves as deputy group leader in the firm’s Global Transactions Practice Group. He also participates regularly with the Arbitration & Mediation, Business Litigation, Energy Industries, International and Telecommunications Practice Groups. His focus is on the law of construction and commercial contracting matters.

Philip L. Bruner, Director of JAMS' Global Engineering and Construction Group, which provides innovative and effective dispute resolution services to the U.S. and international engineering and construction industry. He is cited by International Who's Who of Business Lawyers as one of the world's most highly regarded construction lawyers.

C. Allen Gibson, Jr., a principal with Buist Moore Smythe McGee PA, has more than 25 years trial experience in state and federal courts as well as in arbitration proceedings. He has extensive experience negotiating contracts and provides advice and counsel on dispute resolution, payment claims, delay claims and other issues impacting construction projects.

Jesse B. “Barry” Grove III of JAMS has extensive ADR experience as an advocate and as a neutral in domestic and international matters. He is a prominent construction lawyer retired from Thelen Reid & Priest in 2006 after 40 years of construction law practice. He now devotes full time service as a neutral in mediations, arbitrations, and dispute review boards.

Troy L. Harris, Of Counsel with King & Spalding LLP, is a member of the firm’s Business Litigation Practice Group. He is an adjunct professor of law at Emory Law School in Atlanta, and a lecturer in business law at the Georgia Institute of Technology. He has experience in complex dispute resolution matters, particularly in the energy and construction industry.

David R. Hendrick, senior partner with Hendrick Phillips Salzman & Flatt PC has engaged in over 30 years of legal counseling, claim and dispute resolution, and litigation matters in the construction industry, and is a member of the Construction Industry Large Complex Case Panel of Arbitrators of the American Arbitration Association.

George Anthony “Tony” Smith, a partner with Wienberg Wheeler Hudgins Dunn & Dial LLP, concentrates his practice on Construction Litigation. He has substantial experience in construction contract negotiation, arbitration, and litigation, both domestically and internationally. His experience in recent years has focused on major power plant and other infrastructure projects.
