“This program will address recent changes from the 2009 Montana Legislature, as well as new and developing policy questions. It will also update attendees on water permitting and case law developments in Montana.

Given the continued importance of water use and development to Montana’s economy and environment we have assembled representatives of government agencies, consultants and practitioners to provide insights and suggestions on water related topics affecting Montana.”

Senate and House Bills: HB 40 and SB 396
  • HB 40 - change in permit process for both new water rights (new beneficial use permits) and changes to existing water rights (change authorizations). Process has changed significantly, making the process user friendly. Anyone who has a water right and wants to change the way that water right is used or anyone who may be applying for a new water right will want to become familiar with the new process.
  • SB 396 - describes the impact on landowners whose point of diversion has been altered.

John E. Bloomquist, Program Co-Chair, is a partner at Doney Crowley Bloomquist Payne Uda PC, where his practice areas include natural resources law and water law. He is a former Water Master with the Montana Water Court.

Holly J. Franz, Program Co-Chair, is a partner with Franz & Driscoll PLLP where she practices water rights and government relations. She is past president of the Montana Water Resources Association, a reporter for the Rocky Mountain Mineral Law Foundation’s Water Law Newsletter and is listed in The Best Lawyers in America.

Frank C. Crowley is the senior shareholder with Doney Crowley Bloomquist Payne Uda PC. His current practice focuses on estate planning, trusts and probate, and he also practices environmental law, administrative law and real estate.

Krista Lee Evans is with Blake Creek Project Management, Inc. Previously, she was a research analyst for the Montana Legislative Services Division. She staffed the Legislative Environmental Quality Council and the House Agriculture and Senate Natural Resources Committee.

Professor Cynthia Ford teaches full-time at the University of Montana School of Law and in the summer she teaches the Honors Lawyering Program at Golden Gate University in San Francisco, California.

Senator Bradley Maxon Hamlett is a Montana State Senator for District 10, and a fifth-generation Montanan making a living as a cattle rancher. He is a member of the Environmental Quality Council, the River Governance Committee and the Water Policy Interim Committee.

Joe Kolman has been an environmental policy analyst for the Montana Legislature over the last six years, working on the issues of water, oil and gas development, land use and wildlife.

Terri McLaughlin is the Water Rights Bureau Chief of the Water Resources Division, MT Dept. of Natural Resources and Conservation. The Bureau administers the Water Use Act of 1973, water permitting and change of existing water rights.

Anna Miller is the Financial Advisor in the Conservation and Resource Development Bureau of the Montana Dept. of Natural Resources and Conservation. She works with state loan and grant programs and the Federal State Revolving Fund program.

Senator Terry Murphy was elected a Montana State Senator in the 39th District for a four-year term in 2006. He was a member of the house of Representatives 1971-72, and of the Senate from 1975-78.

Peter G. Scott, a partner with Gough Shanahan Johnson & Waterman PLLP, serves as regulatory, litigation and general counsel for private, corporate, non-profit and governmental entities in the Columbia River Basin. He is a registered lobbyist.

Abigail J. St. Lawrence, a Senior Associate with Doney Crowley Bloomquist Payne Uda PC represents a variety of clients in regulatory, administrative, and litigation matters. She focuses on issues affecting Montana agricultural interests and private property owners.

Deborah Stephenson, a Senior Associate at WestWater Research LLC, has experience working with municipalities and communities throughout the Western U.S. on water supply planning and development.

Senator David E. Wanzenried, of the Montana State Senate, has worked on the House and Senate Natural Resources Committees, the Reserved Water Rights Compact Commission, and as chair of the Environmental Quality Council.

David L. Weaver is a partner with Nash Zimmer Weaver & Grigsby PC where his practice emphasizes water law, real property law, and commercial transactions. He currently serves as general counsel for the Association of Gallatin Agricultural Irrigators, Inc. (AGAI).

Candace F. West is Chief Legal Counsel for the Montana Department of Natural Resources and Conservation. Previously, she served as Assist. Atty. General for Montana from 1991 through 2007.

Matthew W. Williams is a partner with Williams & Jent PLLP. For over 25 years, his practice has emphasized water and environmental matters. He represents various water organizations and users in the adjudication process, and developers of land and energy resources that seek new water supplies.

Anne W. Yates is Deputy Chief Counsel for Water for the Department of Natural Resources and Conservation. Prior to this, she was in private practice in Washington, D.C.
